If my finance owes back child support can the IRS take my return and apply it to his balance if I claim him as a dependant? We are NOT married and he has no income.

The IRS will not take your refund for a dependent's back taxes. Since he is not a taxpayer on the return, no part of the refund is his.

If your fiance has income of $3,300 or more from any source, you cannot put him as a dependent on your return. Since the IRS knows that this person has back child support owed, this may cause your claim of a dependency exemption to be questioned.

I would err on the side of caution and keep him off my tax return, if it were me.

No, the IRS cannot confiscate your refund.

I know it's none of my business but I have to ask: Why the hell are you supporting a dead-beat dad? And why are you actually considering marrying this waste of space?? The odds that your children will be the next victims of his failure to support his kids is virtually 100%, girl! It's your live, but I'd be kicking that turd to the curb!

I think they can only take it if it is his return, like if you were filing Married filing Jointly or something. Or if he did his own return.

You REALLY want to marry this guy who can't own up to responsibilities, doesn't work and lets YOU support HIM?? Might want to reconsider that sweetie. :)
