I left my husband approx. three years ago and 'got lost' to get out of a VERY abusive marriage. I have never filied for legal separation or divorce due to finances but when I got a job last year I put married on my tax form because I thought that was right. Is there ANY way that I could be considered not married due to the circumstances and be eligable for the Earned Income Credit? Or anything else. Is there any qualifying length of time?
ALSO - if anyone may know any web sites that would give a good list of possible eligable tax deductions, that would be awesome!

Listen.. always stay as far away from your husband as you can and stay married to him for as long is it is possible.. you are married until you or he is granted a divorce. the longer you stay married the more of his share of retirement you earn.. if he has a good income let him keep it and you list yourself married filing seperately..or individually.. for as long as you are married you get the benefits of the marriage.. Just don't let him know where you are.. good luck

If you have dependent children that you can claim as exemptions you may qualify to file as HoH and possibly claim the EITC.

If you don't have any dependent children your only option is Married Filing Separately. The only way that you can file as Single is to get divorced or legally separated.
