We live in nc. A few days ago My husband and I were involved in a car accident, the lady drove thru a red light and hit us as we were turning she was going pretty fast. The problem is that I didn't have insurance on my car. Am I going to have to pay for damages done to my car eventhough she was the one that ran thru the red light?

Where I live, an uninsured motorist has no recourse ... because they were not insured, they were not legally on the road, therefore, if they had not been driving illegally, the accident would not have happened ... this is the reasoning here.

So, even though the other driver may have been at fault in running a red light, the uninsured driver is "more" at fault as they should not have been on the road to begin with.

You will have to check your local laws. Just hope you don't end up paying HER damages as well!

If NC is a 'no pay, no play' state then it is possible that the fact you do not have insurance may bar you from any recovery from the other persons insurance company. If so, you will have to sue the driver and state your case before a judge. If not -- then her insurance (providing she HAS insurance) should pay for your damages under her liability coverage. This is assuming your side of the story is correct and you are without any negligence.
Helpful hint: insurance doesn't cost -- it PAYS.

Her insurance company will pay for your damages, however, assuming you were injured you may not be able to recover those damages.

Although she may have ran a red light, how did you NOT contribute to this accident? Be prepared to answer that question to her insurance company as you may be partially at fault.

Depends on the state law....in california anyone involved in an accident and not insured has no right to collect....it's a pretty sucky law...but I would say no...the person at fault would be liable.

you should claim on her insurance, at the time she should have given you the address of her insurance company, try not to involve the police since you were drivig without valid insurance which is an offence.

get a lawyer....ASAP. Most will work for free and collect a % of what they collect. Good Luck!
