I rear ended another car in freeway. The police report is not ready yet I want to know your opinion on who is at fault. I am in california .
I rear ended the other car at 1 am where there was no traffic. Of course I was going with the flow of traffic and I pushed on brake when I saw the car. The car didn’t have proper lighting or any flasher blinking and was either stopped or going 5 mph. my speed was 65 mph and I dont think I had any other choice because of the difference of the speeds.
(Do a simple math 65 mph means 100 ft per second how far you usually see in freeways
And even if I see the car how should I know if it is stopped if there is no brake light)
I still dont know exactly why the other driver was going so slow in speed lane. since he got arrested at the end I guess he was either on drugs or too drunk to be able to drive properly at the end he even engaged with officers and tried to escape. tell me what you think

I know the california law is that who ever rear end another vehicle is generally at fault but does it mean you can go 10 miles per hor in speed lane while you are drunk.

free way 5 north band and close to lake wood exit I think it was on the curve to which also limited my sight

Come on, which is it? How can you go with the flow of traffic if there is no traffic?

Yeah, you were on a freeway in California with only ONE lane, no shoulder and no emergency lane. You pushed the brake pedal but did not think to turn the steering wheel?

I hope you can tell the judge a better story than you are telling us.

If you rear ended him he could be at fault for interfering with the flow of traffic (especially if drunk and no lights). If he got arrested and not you then count your lucky stars. He probably was drunk. I know I've meet a few. The officer might decide it was a "no-fault" accident. Good luck. Let us know how it goes.

the general idea behind the "rearend" law is no matter what someone is doing in front of you, you should be going slow enuf
to avoid any thing in your path. sounds like you have a good case
though. i would seek the advice of an accident attorny.they will
usually review your case for free & tell you if it's a good one or not

generally if you hit someone from behind you are at fault but if the person is drunk not so sure you could have recourse there.
