i have a full time job and live in our home that we own jointly we are seperated ,i take care of my kids with very little support ,can i file married but seperate and claim my 3 boys on income taxes ?my huisband hasn,t lived in our home in over 1 and1/2 years

In order for you to file head of household your husband has to have been out of the house for at least 6 months. Dont know how long he's been gone, but on tax form, just say he's been out over half the year. As far as claiming your children, you can claim your children as long as there is no court order stating otherwise but you should talk to your husband because if they are all both your children, he will probably file too and then one of you will get penalized for claiming them.

Check with the IRS (a phone call away), or a tax preparer. It changes every year. It used to be that you could file single, as head of household, if you can prove that you are providing a certain percentage of their care. Your ex to be may also try to claim them, but if you have receipts, etc. to back up your head of household claim, you do the claiming.
Get financial help; too many women don't at this time of their lives, and end up hurt by the system. Your husband will get all of the financial help he wants; you do the same. It can be free, or you may have to pay for an hour of consultation from an attorney, but you will then have the correct information. This can mean thousands of dollars over the years.
Please, forget we women aren't supposed to know these things. Get educated, for yourself and your kids. Don't take advantage of your spouse, but don't let him take advantage of you, either.

You may be able to file as head of household which has more advantages than married filing separate. In your situation, it becomes a race to the IRS. If your husband files first and claims the kids, you may not be able to claim them. Talk to a tax advisor or call the IRS at 800-829-1040 or www.IRS.gov. Good luck.

Yes, you can file without any problem. Move forward with the divorce and get the questioned resloved legally, but if the children are living with you and you are the primary caregiver, there is no problem at all. Be able to prove this point if there are any hassles with your husband.

Since the kids live with you then you should be able to claim them.
