Based on the Qur'an, one may/must be willing to kill when being oppressed or not allowed to practice Islam, or engaged in actual battle, with the following stipulation:
"But if they incline to peace, you also incline to it, and (put your) trust in God. Verily, He is the All-Hearer, the All-Knower. S. 8:61"
There are other kinds of capital punishment found in the Hadith literature and tradition (adultery of married persons, active apostasy), but in the opinion of many these are outdated or at the very least human creations.
It is notable that Muhammad let the inhabitants of Mecca live once he had safely captured it.

-When non-muslims prevent islamic laws from becoming the law of lands.
-When non-muslims dont agree to subjugation to dhimmi status
(Second class citizen that have to pay a fine for not being muslim, they are forbidden to preach their religion or carry religous relics)
The Quran
Sura 9:29: Fight those who believe not in Allah nor the Last Day, nor hold that forbidden which hath been forbidden by Allah and His Messenger, nor acknowledge the religion of Truth, (even if they are) of the People of the Book, until they pay the Jizya with willing submission, and feel themselves subdued.
-When someone insults Islam (Tradition started when Muhammad ordered the assassination of abu afak and asma bint marwan for writing satrical literature about him)
-For adultery provided 4 witnesses (if a women has sex or is raped and gets pregnant she is convicted of adultery if she cant produce 4 witnesses) and for apostasy (leaving islam)
The Quran
Death for apostasy:
Sura 4:89 They long that ye should disbelieve even as they disbelieve, that ye may be upon a level (with them). So choose not friends from them till they forsake their homes in the way of Allah; if they turn back (to enmity) then take them and kill them wherever ye find them, and choose no friend nor helper from among them,”
The Hadith
Sahih Bukari Volume 9, Book 83, Number 17:
Narrated 'Abdullah:
Allah's Apostle said, "The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims."

The Koran states ... "Death to the infidel". This refers to the unbeliever and I am tempted to think it refers to spiritual death. As in other faiths/belief systems, killing is not a sanctioned practise.
You will not infer this from the rhetoric of the fundamentalists of ANY religious group, however.

Death is allowed in every religion. No one has found a way to avoid it. Killing is only permitted in cases of egregiously bad grammar.

Depends on the situation and judges. If you see two MEN having ANAL SEX and kill them, I don't think too many Islamics will care much, let alone the AUTHORITIES.
Do you. Do you think Iran, Iraq, Eqypt, Pakistan, Somalia would do anything to YOU if YOU killed two MEN having ANAL or ORAL sex with each other!
If so, SPEAK NOW or forever hold your peace!
If YOU think Iran, Iraq, Saudi, Egypt or Somalia will GO AFTER YOU for KILLING homosexuals IN THE ACT of HOMSEXUAL SEX, speak now and let's see what those countries say!
I will GLADLY e-mail the authorities in THOSE states and GIVE THEM YOUR YAHOO AVATAR and TELL THEM YOU THINK THEY CARE about homosexuals and YOU don't THINk they'll go after anyone who kills homosexuals.

The major one I believe is first degree murder, one that is planned and done. Another could be a stranger planning to rape another stranger male or female, the doer.
