Depends alot on what county your in many counties will offer you a reduced sentence of DWAI which is a traffic violation rather than a criminal offense. Even with that you are facing a fine, a suspended license, having to go to a 12 week class, victims impact panel. If you work they will allow to get a conditional license to go to work and a couple hours of week to take care of personal stuff. Your first task is to find a lawyer that specializes in DWI defense, trust me it is worth it. Also, you need to not ever let this happen again if you have a drinking problem or if it was just bad luck you need to assure never letting it happen again. Because even if you get the DWAI and then get another alcohol or drug related offense within 5 years you will get a felony DWI which is a whole new world of punishment. Good luck.

This is the law of New York State.

It's been 5 yrs ago for mine in California. It's about the same. Pretty much, they gotcha. Plead no contest. Its about $1500 fine (which you can do in installments). About 40 hrs. of community service. I chose straight time (U will most likely have to ask the judge for this, which he will grant). Went in on Fri at 5PM and was released about 9AM on Sunday or you will be picking up roadside trash for 8hrs a day for 3-4 weekends. Straight time, you won't have to work. Lost liscense about 6 months, however they will allow you a modified one for work/school/etc..My insurance only went up $15 a month. I think it's 3-5 yrs of zero tolerance (when driving you must be .00 blood). Stays on record for 7-10 yrs. This may have changed. Consider it a lesson learned and share your experience with your friends.
Don't even waste the money on a lawyer. Go to the court house one afternoon and see how the process is so you will be confortable when it's your turn.

If its your first one ever then U might be able to "get out" of it by agreeing to go to diversion class. Its about 12 weeks long and its kinda expensive but it lets u keep your license and it keeps it off your record!!
