My boyfriend owns a party store in Detroit Michigan.A couple weeks ago a Detroit foods inspector came in unexpected and found some bread that was expired.The inspector issued a ticket under my boyfriends name. A couple weeks later he went to court for the ticket -he ended up paying a $400 fine. The judge told him that if this happens again he could face 45 days in jail[i dont even believe thats true-i think the judge was trying to scare him].This TOTALLY freaked out my boyfriend.He tries his hardest to make sure no food is expired but it is very hard to do so.[Even big chain stores have times where food will become expired] what i want to know is - if this does somehow happen again and he does get jail time for this - would he be able to get bond? I have been looking on google to find someplace that i could call to find the laws of Detroit on expired foods-but could not find anything.If you could please give me some advice-or somewhere that i could call for questions on this issue.

Check out sites about Food Inspectors. If it happens again he will get a hearing in front of a judge and he should get a lawyer who can work the system. I doubt they would use up precious jail space for such a minor offense.

Try searching out the Dept. of Consumer Affairs, sometimes they have a section or dept. that deals with inspecting groceries, restaurants, etc. This should fit your b/f's business too. Look in the city directory for health inspectors, that should give you a place to start. You could contact them and ask for the right agency. Then, call and ask, politely how you can get a copy of the rules and regulations concerning the handling and selling of foods. I really doubt that your b/f would be sent to jail, but COULD he be sent, probably. Jails are far to crowded to send someone to jail for expired food. However, he could pay more in fines next time it would happen.

It is a serious violation. Yes other stores have it happen to but they don't get caught by an inspecter. Thats the key issue, not letting an inspector find it. They can shut his store down for any tiny thing if they want to and there isn't anything he could do about it. He would be able to make bond but might still have to do the time.

They typically deny bond for people who are a danger to society, or who are a "flight risk" meaning, law enforncement is afraid the person will run away to a different state or country.

I don't think your boyfriend fits into either of those categories, and he has an establishment in the community, so he could probably make bond.

maybe help him inventory the products to make sure they dont expire. This would be almost a daily task. If you cant help him and he cant afford to hire help, then consult a lawyer, you might can get one to just answer a question over the phone.

Try to expand your search. Try, "food laws in america" "expired foods" " expired food laws"

I can understand wondering and wanting to find the answer. A wiser expenditure of energy is to check the food on the shelves for expiration dates.

Actually it's spelled DYING...But to answer your question... If a judge sentences your friend to jail... HE GOES DIRECTLY TO JAIL!!!!! NO BOND!! A judge can pretty well do what he wants to in HIS court.

If he is giving jail days then he will have to serve them and will not be able to post bond
