I am 28 and I am filing '06 taxes as HOH. I qualify for EIC and I have 2 children, 6 & 7 mths, and I came across this question. Do I say Yes, I want to mark this person as HOH qualifying dependant? I am confused.

In order to claim HoH status, you must have one or more "qualifying dependents" in tax parlance as well as meet other qualifications.

The software you're using is just trying to decide if the dependent is a qualifying dependent under the rules. It's obviously decided that the dependent qualifies you for HoH status and is just asking you if you want to list that dependent as such. Normally you'd answer "Yes" to that question.
