Im asking because my step daugher ( who is 4) came to our house( me and my husbands) with a big hand print bruise on her!!! I called the cops and they are making a report and everything but I am just wondering what kind of proof they have to have that is women is unfit !!
Thy took pictures of the the litttle girls bruise and she told them who did it also the mother never takes the child even though she has custody for days at the time !! has no job or anyway to make money but sit on her *** on welfare!!! Also is prego with her 4th child!!! Sleeps all day with infant and toddler childern screaming and crying !! Yells screams and cusses at all the childern !!! Boyfriend who is on parole beats on her in frotn of these childern!!! Never buckles any of these childern up in a car seat !!! one time i say her baby who is 3 months old in the care seat faced forward not buckled up at all !!! So I guess what im asking is do you think the state with take my step daughter away from her????

Oh and 1 more thing she left threating messages now that the little girl is in protective custody with us !!! One said she was gonna fuckusup the other calling me a bytch and threating to whoop my *** so she said could this be used against her as well ??

The boyfriend on parole who, you say, beats her in front of the children? That could be a reason for the state to take the children away. (Of course, his parole may be for nothing that the state would care about.)
Screaming and cussing at the children? Possibly, but it would have to be severe.
Not buckling the children could get a warning and a ticket at first. Habitually not buckling them and letting the baby face forward and be unbuckled could (and in my opinion, should) be considered neglect.
Her being on welfare? Without a job? Pregnant? None of your business. Being pregnant and on welfare may not be a good idea, but it is certainly not going to be a factor in a mother getting her children taken away from her. Just because a mother is on welfare does not mean that she is not a good parent. A person on welfare is sure as hell not automatically unfit! There are people with million dollar homes who beat their kids... should they be exempt from attention from children's services because they have money?
The handprint is going to be the initiating factor for the investigation, but I don't know if that alone is going to be enough for the mother to lose custody completely. It's going to depend on the case worker that is assigned to the case worker. It could also depend on how the bruise is (and other things are) explained. From what I've heard about children's services, it could even depend on what kind of day the case worker is having.
If you believe this child is in danger, your husband should go for sole custody. It may be easier for him to get sole custody based on the bruise, than for the state to take away the child based on the bruise.

Ok. you need to take pictures of the bruise, record the conversations, get a room ready for the 4yr old with every thing she needs clothes bed etc.. take pictures of it set her up in a good preschool to show the court shes learning and has a good reason to stay with you call welfare/ child services notify the of all the problems have other people who have seen this behavior from the mother and just keep calling u and the other people the more the better good luck take her to court

that seems like grounds to lose the child to me, but some states are not quick to pull the kids out. Sometimes it takes alot more. They might just make her take parenting classes and have unannounced visits for a period of time by a social worker. Sucks I know, but unless you get a lawyer and sue for custody chances are nothing much might happen even though thats a really big deal.

This woman sounds mental ill. If indeed all that you say is true, this woman needs medical attention and a full institutional staff. I would pursue litigation on her in a court of law for harrassment. Begin with a restraining order, and sue for each and every infraction. The cost will be high, but you will stand your ground and you will keep your sanity too (which is more than this woman could ever hope to have)
I don't know about you, but I'm tired as hell of the mentally ill bullying us fully functioning, reasonable people.

there does not have to be any proof. the state can take peoples children for absolutely any reason at all-even if they are not abusive or neglectful. sounds like this women is though. it depends on the state as to how on the ball they are. i suggest if these children are in fact abused that you call child protective services and continue to call until something is done.

I would hope that they would get help for this child and if your husband is the father he should be the one to get her if they do take her away from her mother. I would speak to the Child Protective Services and find out whats going on for the child, and where she will go

you really need proof that she has done these things really proof not just cause you say so. Im glad you involed the police tho a lot of poeple just stand back and hope it gets better i am the same as you with my brother in law when i tried to get my niece away from him it was a long process but in the end i won she she healthy and safe now i watched him all the time and 1night i noticed he had gone to the pub and hadnt come back i went looking for my niece she was sat round the back of her house waiting for him to come home i took her to my house and waited when he hadnt returned for midnight i phoned the police they they told me to keep her with me and they doucumented it and got in touch with the social services

Document and save everything. They will keep everything on file. This woman sounds as if she shouldn't be having children. Just stay in touch with DHS, they will take the children away if they find abuse, which sounds to me like there is.

I guess it all depends on the state you live in. Some states favor the mother. I know that in the state I live in, it's almost unheard of for a mother to lose custody of a child. Basically, you need to make your case. If you can prove to the court that she is an unfit mother, she will lose custody. Most states nowdays are looking out for the best interest of the child. If you can prove that she is not looking out for the best interest of her children, I would say the odds are with you.
