So I must wait indefinately. They said they'll ship me one if it becomes available but the wait can be a month to over a year. Their represenative told me my other option is to buy their New Model, at a 25% discount. Is this type of practice lawful?

You would think that they would have a comparable or higher end model that they could offer you in exchange. That is practice for many retailers faced with a similar situation....upgrade them. If it is too much of an upgrade to eat the whole difference in price, offer to split the difference 50/50 with the customer. It isn't your fault that model is backordered. Is it backordered because everyone is having trouble?

Our state's attorney general has a website where you can file complaints for things like this.

I don't think so, sounds like they're trying to play you. Can you just return the old one for refund because of defective? Then buy a differend brand as a replacement!

tell them you will fix it up!
by going to the newspaper or t.v. ....see what they say, but be very very calm...just say o.k. I think it will make for a funny story!, while I am waiting...give a little laugh, as if you don't care.
See also that you tell them, you have every intension of saying ...that they will replace it! but could take a year...Never let them know, your upset! treat it like a funny thing?....and they will think! your very serious.
Then maybe....they will come around.

Complain to http://www.ftc.gov/ftc/consumer.htm agency for consumer protection and also to get that brand off the shelf to protect others.

Mail the defective one and send it by registered mail and tell them you want your money back.
