Probably... if you are pretending to be that person it's identity theft. Why would you want someone else's credit report???

To legally obtain someone else's credit report, they will have to agree, preferably in writing (like for a loan or rental application). Otherwise, they may not charge you with ID theft, but they can press some sort of charges.

They can't charge you with identity theft unless you have assumed that person's identity. You did use someone's social security number to obtain a credit report. That is fraud.
