a muslim women who complains that she has been raped, and if she cant produce 4 male witnesses who actually saw the penetration , will be given 80 lashes (sura 24/4)
which means that a muslim woman who gets raped never gets justice.

am i right?

As usual you are WRONG. you twisted the verse of the Quran 180 degree to prove your point.

the same question was asked by MUTRADA and I answered her to find you posting the same question with the same reference to the same surah.

here is the translation of the verse in Surah 24

And those who accuse chaste women, and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever. They indeed are the Fâsiqûn (liars, rebellious, disobedient to Allâh).

and the one who will be lashed is the one who is going to accuse the women of committing adultery. He is the one who has to produce the four witnesses otherwise HE will be lashed 80 times and will be considered a liar and his testimony will never be accepted.

tell me how difficult it is to get FOUR witnesses who will testify to seeing the "actual penetration"?. I think the chances of finding four is next to nothing."

so hopefuly you will see that the one who accuses some one else with adultry will be lashed 80 times because there is no way he can produce four witnesses.

I thing 3 witnesses are required, but the fact is that a raped Muslim woman takes a great risk if she complains, and legal physical punishment is Just the tip of the iceberg, because if she can not convince her relatives of the rape, she is very likely killed for the shame she causes her family.
So the best thing a Muslim woman should do, if she is raped, is shut up and marry the rapist, if he is willing, and if not she will probably be raped again and again, and if she becomes pregnant she will very likely be killed.

No, you are not right.

rape is not a sex crime. the accusation of pre-marital sex and adultery are the ones that need 4 witnesses or the sworn testimony of the man or woman who had the sexual relations.

it disgusts me to know that there are Muslim women out there who have reported they had been raped and then got punished themselves as adulteresses for not being able to provide 4 witnesses to the rape!! This is not from Islam!

here is the hadith that shows there is not rule for 4 witnesses:

She shouted and he went off, and when a man came by, she said: That man raped me. And when a company of the Emigrants came by, she said: That man raped me. They went and seized the man whom they thought had had raped her and brought him to her. She said: Yes, this is he. Then they brought him to the Prophet (peace_be_upon_him). When he (the Prophet) was about to pass sentence, the man who (actually) had raped her stood up and said: Apostle of Allah, I am the man who did it to her. He (the Prophet) said to her: Go away, for Allah has forgiven you (for the mistaken identity). And he told the wrongly accused man some good words, and of the man who had raped her, he said: Stone him to death.

it really horrifies me that there are Muslims who ignore this hadith!! it clearly shows there is no 4 witness rule.


there are many Muslims who are living in a time of ignorance right now because they are not studying the Qur'an and the hadiths from reliable scholars.... they are listening to some people who call themselves scholars but in reality are only teaching their own beliefs and/or cultural practices even though they go agains Islam.

NO. you're not, you're talking about accusing "zena", which is 2 having sex without getting married which is not allowed in Islam. so to prove that 2 have had sex (in order to punish them), at least 4 have to witness the sex process where they (the 2 that are having sex) reach the part that leads to children. but this never meant to be for raping!!

It happens more often than you think. They rarely get justice , I would assume. But progressive socities such as Morocco. Dont in anyway shape or form condone or adhere to this , backwards rule.
