My wife just asked this question last nite. My answer: You can do anything you like in extreme situations, but you'll definitely have lawsuits and disciplinary actions against you afterwards!

Yes , but all liability for the vehicle is passed onto the agency of the Officer who needed the vehicle for an emergency purpose.

Rarely if ever do the police take a vehicle for such a purpose. They may also use your vehicle to assist with emergency road blocks.

But lets just say the Chief or sheriff or commander of Operations will be out of town for comment during the situation.

Yes, but it is highly unlikely. Most police officers have there own vehicle an do not need to commandeer your vehicle. Now on certain occasions an officer may be on foot, and a situation may arise where an officer might need to pursue a vehicle, that's one purpose of an officer having a handheld radio (motorola). Maybe, they can not sieze private property by Constitution without court hearing.

But in extreme emergancy they could, but most of the TV shows alot of those are not extreme emergancy and the other cases just don't happen.

And of course since doing that opens the police up to all sorts of legal suits against them for liability it would never happen.

In an emergency situation there is a provision for them to do this.If they total your brand new 2007 car/truck, you can file a claim for reimbursement , but good luck, the money may NOT be forthcoming until months afterwards, and in the meantime you are left without transportation. This is a great country isn't it?

sometimes yes, lets say there is a life threatening situation
and the police officer hit his car and it stopped moving, he can stop you show you his badge and even force you out of your own car if you were not leaving it yourself.
but it only happens about 15 time per year here in Canada.
after the car is took you have to call 911 immediately and tell them
they will know that he took your car because he has to inform them first otherwise he have robbed your car.
before the car can go back to you it has to be tested to insure it is still safe to drive. if not it will be fixed. and if its damaged it will be replaced

why would a police officer really need to commandeer a vehicle... they have their own vehicle that is rigged to be one of the fastest on the streets

Unfortunately yes, but if during a chase, they wreck it, you suffer the loss of the use of the vehicle, and it will probably would take forever for the city to compensate you for your loss. That is the way the bureaucracy operates.

Yeah thay can if you never get it back or it blows up or has any mark that wasnt there from befor you can sue the police department the cop that took your car came from this has happened to u befor?

Yes, they can.
And if you refuse to let them, you can - and will - be arrested for either obstructing an Officer or aiding and abetting.
However, the Police have a responsibility to protect your property, and they will be expected to pay restitution for any damage.
