i was just in an accident in the state of illinois driving my moms car. the accident was my fault. i went to change lanes and the sun blinded me and i did not see the car beside me. minor damage to the cars. i found out my moms car has no insurance on it. what will happen to me? i have to go to court for my improper lane usage and failure to provide insurance but now i find out she has NO insurance so when i go to court what will happen? will i go to jail? and for the fines, will i have to pay that day?

thanks for the info guys- i tried to call the number on the form the cop gave me but they didnt wnat to talk to me- my moms insurance expired 2 weeks ago and i had no idea- i am more then willing to pay to fix their car- lose my license and pay the fines (as long as i can work out a plan to not have ot pay that day or all at once) i just do NOT want to go to jail that is my biggest fear- it is required in teh state of illinois and i know that but i did not know the car i was driving was without insurance or i woulda never taken it- and yes i am totally at fault for not seeing them- and said that the min the cop came up- no excuses they simply were in my blind spot-- i just wondered if i would be looking at jail time or if i had to pay the fine the day of court- i thank you for your answers and welcome any other suggestions answers- this is my first accident and first court for anything- im scared 2 death!!

THANKS AGAIN TO THE KIND REPLIES AND INFO- i did talk to my uncle who is a lawyer this morning- he said there wont be any jail time and if i go in with insurance - or my mom does- they will likely throw that ticket out - we will have ot pay for hte improper lane usage and to fix the headlight on their POS ****- which we knew and thast fine by us- i just hope we dont have ot pay that day- he said it depends on the judge- so looks like i start saving up! thanks again guys!!

Good grief, you're not going to jail for a car accident unless you were impaired or involved in some other form of criminal activity at the time. Yes you will pay to repair the other vehicle (and you will likely be shocked at the cost of that repair) and yes you will pay for all the fines you received. Be thankful no one was hurt and live and learn. But stop worrying about jail time, that is not going to happen.

Well lets look at the potential.

Most states have mandatory insurance requirements so we will work from that perspective.

1) You got a ticket for a bad lane change
2) You were cited for failure to provide proof of insurance .. that will likely be changed to driving an uninsured vehicle
3) If insurance is required to register a vehicle in your state you may also get a ticket for driving an unregistered vehicle.

ok.. those are the potential tickets and fines. and, as I read your comments, you ARE guilty of them - right?

so.. you and your mom need to saddle up and go to court on the appropriate day. You square up to judge and tell the truth but stress how you have always been allowed to use her car and she wasn't there that day.. or whatever the situation was that led you to using her car.

Your mom can possibly support you in that this was the normal practice and that you did not know that she had cancelled the insurance...

That MIGHT get the judge to ease up on two of the three .. it MIGHT not... you have no real excuse for the lane change so don't try to make one up.

So.. you will be fined for something. Most courts will allow you to work out a payment schedule.

Jail.. that is unlikely .. worst case might be a few weekends on the cleanup crews "public service".

But.. if the judge goes down hard, then you may lose your license for a few months..... (consider it a harsh lesson but a fair one if you don't get anything worse).

Meantime: you damaged someone else's car and you are liable for

1) The repair of that car
2) Any reasonable auto rental while the car is being repaired.

Cowboy up and get over to that person and work something out. BEFORE court. If you can tell the judge that you stepped up and did the right thing there (and maybe even bring that person to court as a witness) that can only help you.

if you don't work out something with the other person he sue and collect anyway so you might as well take the high road,

The accident was your fault, so you will have to pay to have any damage repaired. Illinois requires insurance, so the owner of the vehicle will be responsible for getting insurance on the car, and if she doesn't it could lead to them revoking HER license for having an uninsured vehicle.

As to the fine, and arrangements to pay it, that will be up to the pleasure of the court when you appear. It will go much better for you if you can show that there is now insurance on the car when you appear at court.

I'm from UK dont know whether its much help but if you get caught driving without insurance you normally go to court and get a ban which could be anything between 6 months to indefinitely and as for the fine you can normally pay bit by bit if you can't afford it but you will need to pay to stop further punishment e.g prison or jail

you are asking question that you should have asked before you got into your mother car.and your mother had no busness letting you take her car with no ins.I think both you and your mother is going to jail.
