My husband uses an ITIN for taxes because he is an undocumented immigrant. I am a citizen thus I have a valid SSN. We have 2 children. He worked last year but I didn't. Can we qualify for the EIC? How?

There are people in my husband's family receive thousands of dollars for their refunds and all are undocumented with itins, nobody has a valid SSN. How is that possible?

In order to receive EIC a taxpayer and spouse if married and filing a joint return must both have SSN valid for employment. So if you file a joint return, you can't get EIC.

You, the spouse with the SSN, cannot file as Head of Household because you had no earned income in 2006. So even if you did not live with your spouse for the last six months of 2006, you can't use the filing status Head of Household and get the Earned Income Credit.

Is there is another relative in the home, such as an aunt, uncle, or grandparent of the children? If this person has a SSN valid for employment, has earned income, and lived with the children for more than 6 months in 2006, that person could file and use the children only for the EIC and may get the EIC. That way the household would be able to get EIC. But there is no way you and your spouse can get EIC.

If you can have a relative file for the children's EIC as described above, you and your spouse would file a joint return and still claim the children as dependents.
