A cop arrested me in california without a warrant and brought me in for questioning regarding an investigation, I was held for over 2 days and after that they told me that I didn't have to see the judge because there was no case against me.
The detective in charge refused to give me back my stuff that was taken from me when I got arrested. I had a couple of thousand dollars on me and on top of my money he also took my watch, my cellphone, my credit cards and a bunch of stuff that I had in my car like my check book and my mail.

It has been a few months and no matter what I do he won't give me my stuff back, he hasn't even given my belongings to evidence locker. I checked my cellphone and found out he has been using it for his perosnal use, he even changed my password and info. Recently I found out that cops use any excuse to hold on to people's belongings because when the items get auctioned they get 10% also 10% of the cash he took from me
I have filed complaints but no-one cares

I am not a liar, I am not making this stuff up. I was held for questioning, they wanted me to rat out some people. They had nothing on me. As for the person who says having a couple of thousands makes me a criminal, all I have to say is Rent in California costs around $1200-$5000 for a 2-3 bedroom apartment, depending where you live. I can't afford a lawyer, it will cost me 5 times the amount they are holding in lawyer fees.
I have filed complaints with every place I could but they just give me the run around.

Perhaps I am just more gullible, but I am less skeptical of your story than others are, as I have represented people who have had property not returned by the police until I got a court order requiring them to do so.

However, the proof to me would be whether you have a receipt for all this property. If you do, and the police will not return the property, I think it likely that they are intending to initiate forfeiture proceedings, at least as to the cash. They will have to give you notice of that. In the meantime, however, again assuming you have a receipt, I would follow up with Mikeysco's offer (he is an intelligent and honorable officer).

I also think you can file a small claims suit. You don't need a lawyer for that, and it is likely that your local court has someone to assist you. Name both the officer and the department.

If you have proof that the cell phone in the police possession is being used (i.e., you have a bill showing calls made after the arrest), you should make a complaint to the department including that proof.

Cops don't get any portion of a seizure forfeiture. If that were the case, then I'm owed about two grand in cash forfeitures alone. Your best bet is to file a complaint with the internal affairs division of the department which detained you. Although I find it highly unlikely that any department with detain you 2 whole days without so much as a warrant or arresting you. Your story smells a little fishy to me all the way around.

Okay, techinically you were not charged. But sinse the money was probably inolved in criminal activity based on you having thousands. Deal with it and suck it up and be happy you didnt get charged with anything.

Contact the District Attorney, report this and offer to take a polygraph. Any witnesses?

File a complaint with your state's attorney general, and if you charge of police corruption has merit, they will investigate and prosecute the offender(s).

Talk to a lawyer and see if he can help. Call your local political officials, councilperson, mayor, and see if they can investigate.
Contact the internal affairs department.
