I didn't file a MN return for 2005 because I didn't pay state tax because I used to be considered a nonresident (Active Military). They changed the law in MN (my legal state of residence) and it appears I had a refund coming to me. Am I still able to file a 2005 state tax return this late and collect the refund? How long do you legally have to file if you don't owe money or if you have a refund?

if you didn't file the return at all as you said, it would not be an amended form. it'd be considered a first filing. you are able to file up to 3 years ago and still receive any refunds. if you file after that time, your return will be considered out of statute and you will not qualify for a refund. below is the 2005 minnesota individual income tax form.

This year a new law was passed in MN to pay service members who have served in a combat zone any time from Sept 11, 2001 to now. yes you can file,you should cause they may charge you in fees for not filing this may be what you were going to get back.be careful you may now owe.
