They can't kick you off the plane - that would be murder, and opening the door would be dangerous for the whole plane.
The FAA site won't mention the actual problem. Under the present US laws you must obey any order of flight attendants or you commit a crime. If you're caught caressing one another - it doesn't have to be real sex - and you don't stop immediately when asked to stop, you risk up to 10 years imprisonement.
Even if you stop immediately, I guess you would risk about the same penalty as for having sex on any public place.

Alot of it has to do with the flight crew. If they discover what you're up to they have the option of informing the captin so he can decide if he wants to have authorities meet you at the gate, or they can simply ask to to return to your seat. However, if a member of the flight crew asks you to return to your seat and you don't, then you could be arrested upon landing for failing to comply with crew instructions.
I have a friend who is a flight attendant. He usually looks the other way when people do this. He will ask them to return to their seats, but that's about all he usually does.
Do you have any idea how dirty a plane bathroom is? They can be pretty nasty. I'd never want to try to have sex in one, but to each his own.
BTW- Have you ever thought about how dirty the blankets are on a plane? Use your imagination on that one. My friend has pulled used condoms out of the seat back pockets on more than on occasion.

Where did this happen? In your seats? on the floor? in the storage above? in the galley? in the restroom? in the cockpit?

Miles high club! Yes, you can do it but they will arrest you. They are not as lenient as before.

US airlines wouldn't prosecute unless it was blatant and disturbing the passengers.
On airlines that hail from Islamic nations, I hear that they just chop off both of your heads.
