i went and had my pre sentencing report done, in it, the probation officer recommended that i just get a fine and have to pay restitution. my lawyer said she was going to suggest i go on probabtion instead of the fine due to the fact that i am 7 months pregnant and have had so many complications that i no longer have a job. (am pretty much on bed rest). do you think that i will probably get either the fine or probation??? is it likely i will go to jail?! what are the odds of him going against the recommendation?


have always been polite to the judge, using yes sir, no sir, yes your honor, ect. dress nice, and have no prior record.

i'm not expecting the pregnancy to change anything to do with the court date. but that is why i no longer have the job (worked as a youth care worker with troubled teens. too risky to be working with them while pregnant, too much of a liablitiy). that was why i mentioned it. not because i expect them to be different in sentencing because of me being pregnant. just why i no longer have a job

You might be better off with the fine and restitution. Probation, depending on the state and city, can be a reservation for jail time.

It's not likely the judge will go against the recommendation, basically the judge is there to have the final say as to whether or not your representation and the DA have reached a resonable conclusion.

I am guessing you didn't do anything too serious, so I don't foresee anything too traumatic. -Also, the state won't want the medical bills associated with birthing, so they won't want custody of you.

Just stay cool and keep putting on a good show.

Your Pregnancy will influence the Judge, the probability of your receiving Probation is strong since your Lawyer is suggesting it. Since you did not mention the crime you committed it is impossible to give a complete answer. The expenses involved in a difficult Pregnancy will cause the judge to release you on Probation so the State can avoid the expenses of your Medical treatment. However if you killed someone things might go differently!!

It certainly depends on what you are charged with, but with no prior record and the fact that you were working with kids in trouble, and have lost your job when normally the pregnancy would not affect your job, I would have to say it will be difficult for the judge to give you anything but probation and maybe restitution after you go back to work.

most likely probation AND a fine! that is standard for pretty much all offenses UNLESS its a felony! polite doesnt mean squat! ive been thru jails AND 3 prisons throughout CA in the last 20 years! ive been outta trouble now for 5 years! hooray! but trust me ive had a wide range of charges in my time and kno alot about the courts! it would depend on the charge and the circumstances involved.. pregnancy doesnt effect the law..just because you are pregnant and haveing medical problems is not gonna change much

It all depends on what type of person the judge is.He can be lienent if he wants to be, or he can throw the book at you.
