I m from peru and i support my family overseas i heard i ca claim them. I know also i can gwet an itt number for them so I did aply for that last year , they denied because the accountant didniot have a valid seal now i wantto claim them with an amendment for 2205 and 2004 not 2006 becau i dodnot support them that year, what can i do urgenttttttttttttttt

thanks for the answers , now i have another question i already submit my 2006 taxes because i didnot support them on 2006 so that was easy, but when i called the irs they told me fill an amendment form but i dont know if that form had to go my 2006 taxes or can that go by itself , about the residence presence requirement, i asked over the phone to the irs and they said there was not problem if they were from peru but i had to fill an amendment, can i sedn that form now because I want to claim them for 2005 not for 2006 thankssssssssssssssss

Your dependents do not meet the citizenship test or the physical presence test. You cannot claim them on your US taxes.

According to the IRS, to be a dependent, the individual (your family) must be either be a US citizen, a US resident, or a resident of Canada or Mexico for some part of the calendar year in which the taxpayer's tax year begins. Peru doesn't count so you can not claim them as dependents. This is the Citizenship or Residency Test.

dont listen to the guy above you can claim them. File a w-7 again with a certified person and youll get an ITIN within 3 months then youll be able to claim them. Make sure you attach your w-7 to the tax return and make sure you follow the instructions.
