Last year I was arrested for DWI and speeding, despite blowing .06 (the limit is .08) I was charged with DWI. When I went to court the charge was reduced to DWAI driving while impaired, a traffic violation. My question is will it show up on a criminal records check as a DWI arrest even though I was not convicted of this. By the way this occured in New York state. Thanks for any and all help. And, yes I did learn my lesson.

It may not show up as a conviction, but it will show up, and the way it's interpreted, is up to whomever is doing the background check. If you were arrested for "driving while intoxicated", and that is what's on the arrest record, then that's what will show up on your background check. You need to call the criminal courts system, where you were arrested and processed, and they should be able to tell you. You may even be able to contact the actual district where the judge presides, that heard your case and passed down the judgment, and ask his legal clerk/secretary. That's what they're there for!

By the way, the person that responde with the "been there, done that" needs to check the law one more time. Especially your own individual state laws... it doesn't matter if you did this in Timbuktu. You're talking about a criminal background check. They will check to see if you were arrested, at age 14, for stealing a pack of gum. It NEVER hurts to ask the right people, the right questions. Unless someone is a board-certified, New York attorney that specializes in this field...then all we can do is give you the facts that we know. I would really suggest that you go the route I gave you! definite they do practice arrests in spite of if there is no conviction. So if a police officials seems at your historic previous they are going to understand. As for an agency checking it would want to nevertheless take position. there is always a record of someone being booked into penal complicated and reserving information are public record no matter if you're charged or no longer. the actual question is the question on the equipment arrests or convictions?

don't know bout the DWAI, but usually only convictions show up. So the DWI arrest is prob. nothing to worry about.

Probably, I know a guy that that worked for an office furniture dealership that filled out a release to get clearance to do installs at Bechtel without having to be watched by an escort and they refused him because he neglected to notify them of a DWI that he got 18 years prior.

I got my ticket 10 years ago for speeding, and it was reduced to a warning with 6 months probation and it still shows up on my background check.

A criminal history check will show both what the original charge was and what you eventually pleaded guilty to.

If you were finger printed that will go to the fbi and traffic violation or not it will show up. Traffic violations show up anyway

no - your sentence was reduced and a traffic violation instead of a federal one or state one- you were lucky you got .02 less - I was not I blew . 121 and will get my licence back in may of this year
