My girlfriend is in the US on a K3 visa, and will be getting devorced. I plan to marrie her. Do we need to file a new K3 or change status and file for resident. Or what? I dont want her to have to go back to her country

By getting divorced before becoming a Permanent Resident she is giving up her application unless she claims relief as a battered spouse (or perhaps asylum).

Common sense tells me that she would have to leave the country so that you couild petition for her. I really think you need an immigration attorney to advise you.
