my daughter was sexually assualted in our home by a football player, and I filed charges. I was told by the schools asst. principle I could not file or even talk about the incident at the school.so I went to the police dept. the officer that took the report told me a detective would be in touch. they never called me to set up an interview with us, but he abd another male detective, along with another male police officer from the city where the school is got my daughter out of class, put her in a room with all of them and interrogated her until she recanted and said it didn't ever happen. her grades have dropped, she dropped gymnastics where she has been shunned by her teacher and classmates. is there anything i can do about the actions of the school or police dept.? i feel as if she has been raped. the boy that tried to rape her in our home has been boasting about the ordeal and the counselor and asst. principle both who are females told both of us not to even speak of the incident .

Sounds like you live in Oklahoma.

The school wants no part of it, because they don't want to be liable about anything. And the way that schools operate these days, they have their own bi-laws that protect them from anything. As far as the male police officers? I'm nearly positive that they should have a female at least present during the questioning. Because of the sexual nature of the offense and your daughter being a minor.
I have dealt with the school my daughter attends and she got a tooth broken off and another chipped, because a girl come into the lunch room and cold ****** her while she was eating and there wasn't one - not one adult in that lunch room and that is against the Oklahoma state law. But, guess what, alll I got was the run around, but I have made them realize that I'm not a mother to reckon with. And they don't like me and I really don't care. I made a big stink about it and the whole town knows now. It is hard on your daughter I know. You sound like a good mother. Don't let the cops or the school bully you, because they will try. Stand up for your daughter no matter what the cost. In turn you are showing your daughter how much you love her and you are showing the town that you won't put up with this type of behavior. I would go to the sheriffs department and to the cops supervisor and find out what is going on. And in the end of my delimea, I took my daughter out of that school and she is a lot happier. Why do people do this to these children? That school has no right to tell you who you can't talk too. Where do these people get their morals from? A book they found in the sewer I guess. But buck up and fight!!!!!!!!!!!!!!!!!!!!! for your daughters rights!!!!!!!

Lets try to filter out the bad and introduce the good here.

First, schools often try to minimize crimes and other incidents whether they happened in the school or not. They think that even being a victim outside the campus reflects poorly on the administration. Right or not that is normally how they feel. HOWEVER, I cannot say strongly enough that no school administrator absent a court order has the authority to direct your actions, comments, feelings or attitudes. You do what you think is right and how dare an educational administrator even think of trying to dictate otherwise. You stand up to those that work for your tax dollars.

Secondly, the police can talk to a victim at any time without consent. It is the suspect that has all the rights. Come on we know that by now. It is certainly a bad practice to speak with a 15 year old victim as you have described. It is rude, re-victimizes the victim, serves no purpose in the course of cooperation and may alienate.

Third, if you think she has been raped take her to the Emergency Room and your family doctor and allow them to perform the tests available to prove thus. The tests may not be conclusive but if you ever expect a case to brought against the suspect this has to be done.

I'm not sure where Tigerlil gets her info. about they had no right to talk with her, suing, etc.
What I do know is that all of the training I attended while a police officer contradicts what the cops allegedly did in this situation.
What we would do when contacted about an incident like this, is talk with the girl very preliminarily to see if what the caller said is what really happened.
Then we would immediately have a detective from the EMCU exploited missing children's unit talk with her (they do this all the time and are VERY good at what they do). They do the interview in a "soft" interview room, comfortable chairs or couch, soft paint, very relaxing atmosphere with it all videotaped so that discrepancies, or whatever can be investigated later.
I wasn't there, but from what you say, the cops were either new detectives, or were trained in the mid to late 1940s on their interview techniques.

What exactly is your question? What on earth does any of this have to do with the school? I thought you said this incident occured at home. If she re-canted to the Police detectives, it sounds like maybe it was consenual and you can't except that? I would seek out a good family councilor for a few sessions with your daughter if I was you.

There should have been a female dectective in the room and they should not have talked to her without your present or at least without your knowledge. I am sorry for what happened to your daughter, you should bring a civil suit against the police department and also bring a complaint against the school and the boy personally.

Yes you do. Under the feaderal law she is a minor and they can nto legaly talk to her without u there, or ur premission. I would find out there names and file a report with there supervisor, or call him and place a report. And just out of wondering. Why was there a fake report made by you and ur daughter. That is a crime and you can be arrested for that, plus maybe even jail time.

she had the right to have you there with her at the time of the interview they had no right to talk to her without you. I would file a civil suit against the school and the department. You can also consider homeschooling your daughter her grades would probably come up alot and she would be free of the bullying and hypocrytical treatment.
