We never considered ourselves married, he never called me his wife, i never called him my husband....we didnt' have joint accounts - no checking, savings, no joint credit cards....and the fact of the matter is, he married his ex wife if 2005 during the time that he is claiming to be common law married to me.....we aren't married.....and changing your tax returns to show married and claiming my son as his son.....that's fraud......

If he's legally married to someone else, he cannot file a joint return with you. Even if he's not legally married, only a few states recognize common-law marriages and merely living together does NOT create a common law marriage regardless of how long you live together.

If you have custody of your child, you get the exemption. If anyone else claims the child, the IRS will investigate the matter and award the exemption to the rightful party. Most likely that will be you.

If he's committing tax fraud, that's between him and the IRS. You do not need to concern yourself with that.
