I received a fixed penaty notice from the Police that one of my cars was speeding 3 months ago. We have two cars so I really cannot remember whether I or my wife was driving at that time. What should I tell the police? a) dont know which driveer, i or my wife. b) choose one which is more beneficial (but what is more beneficial, please advise). Any suggestion? Any advice?

the safety camera partership has to instigate proceeding within 14 days so if its taken 3 months to get to you then claim abuse of process, if however they have been trying and couldnt get you as you'd moved sold the car changed details etc then they are okay to instigate proceedings now. you should ask to see the photo as you arent sure who was driving, if its clearly show you, then best take it on the chin, there isnt a easy way out. if you dont comply with the NIP then your going to get had for that.
there are a couple of website around which may suggest trying to evade the ticket but most have a sneaky was of catching up with you! best of luck

Firstly it should not be difficult to ascertain which car was involved in the offence - the police will provide the registration number of the vehicle in its correspondence. Secondly, the penalty notice will always be sent to the Registered Keeper of the vehicle. If it was not the Registered Keeper of the vehicle who committed the offence, the onus is on you to write to the police and supply details of the name and address of the driver. With regard to 'what is beneficial' I would advise you that it is not in your best interests to withhold information from the police. By not disclosing the truth you are committing an offence. An FPN for speeding must be issued within 14 days UNLESS you have received a notice of intended prosecution already.

You have a choice: If you honestly do not know which one of you was driving, but it was one of you - then say so. Probably the registered keeper (you?) will be fined.
Or you can decide which of you should get the fine and the points. If either of you already have points, then go for the other one! Either way it will have to be declared for your insurance.

NIP must be issued within 14days, otherwise it is not a legal, have you moved sold the car or in some other way made it difficult for the police to trace you ? if that's the case they are able to pursue the offence, as for who was driving ask them to forward the photographic evidence, this may well help you to decided who was driving at the time of the alleged offence.

As long as the NIP process was started within the 14 days it should not matter what time it is recieved. It for example could get lost in the post. There will be a six month time limit on a potential prosecution.

If you honestly cant remember who was driving,the points will go to the registered owner of the vehicle.And I think it's 6months before your in the clear.

If you say it was your wife, then she will get the fine and the 3 points on her licence. If you say it was you then you will receive the points and fine. If you say that you don't know, then you will receive them on your licence anyhow as you are the registered keeper

Ask for the photo and see if you can determine the driver if not then who ever has the fewest points already on there license ?

unless you can prove you weren't driving then the penalty will go to the keeper of the car concerned.

It must have the number plate on the ticket somewhere, if you committed the offence its cheaper just to pay it.!!!
