If you live in the US, your husband is entitled to the Family Medical Leave Act when you have a child, whether you deliver naturally or through C-Section or even adopt. This entitles him to up to 12 weeks of leave. It does not, however, require his employer to pay him for that time off. He may take any sick or vacation time coming to him during that time to get paid, or in addition to that time, but the 12 weeks of FMLA time is unpaid.........good luck

According the Family Medical Leave Act, if his employer has to abide by the act says up to 12 weeks.

Some points to consider:

Employer has to abide if they employ 50 or more
employees for each working day during each of 20 or more calendar
workweeks in the current or preceding calendar year.

Also your husband needs to have been working there at least one year and/or have 1250 hours of service. You can read more at this site below. It's the actual law.

BUT, please note. This does NOT guarantee your husband's job will be there when he returns. Nor, does it guarantee that he will receive the same pay when he returns.

Most employers are understanding and let the empoloyee leave for the baby for a week. But, if it's pushed they may get sneaky and give him a lesser job with less pay and that is perfectly legal. Also, your husband may not be entitled to this benefit at all.

Does he have sick days or vacation time? Do you have family that could come and stay with you instead? My mom came and helped me so my hubby could go back to work...

Also, you should consider that the employee does not have to pay your husband for that time off. Unless, your husband has accumlated sick leave, personal time, or vacation time.

Where do you live?

In Canada...maternity leave is 15 weeks, and parental leave is 35 weeks. That's a total of 50 weeks.

Parental leave can be split between either parent. So if Dad needed to take a month off to help Mom out... then Mom could stay home for the 15 weeks of maternity, plus 31 weeks of parental.

In the US under the Family and Medical Leave Act (FMLA) he can take up to 12 weeks of UNPAID leave without being fired. The question is, can you go that long withou the income? Another question is, are you in the US? You didn't specify where you live and from the grammar I'm thinking maybe another country.

where are you different places have different laws in canada the is 35 weeks of parental leave but that is for both parents combined and can be split or taken by one i took all of mine i had to carry him for nine months its only fair plus i breastfed till well over a yr in canada you get a total of a yr 15 weeks are pregnancy leave

the national average is 5-7 days to be at home...however theres a lot of companies giving more but without pay, sometimes up to 2 weeks.
