Yes, it would probably be a good idea. It would help the people you're giving the cat to understand that you're serious about it's care. If they plan to take good care of it, they shouldn't object to having reasonable requests in writing.

I would insist on the right to come and visit the home & people where the cat will be kept prior to giving it away. I'd also insist on the right to come & visit the cat, to check on it & make sure it's being well kept. If you want to be sure it's kept inside, make that clear. If you want to make sure it doesn't get declawed, state that too. If you want the cat to come back to you if the person can't keep it, be sure to include that in the agreement. Contact your local animal shelter and ask them for recommendations on other questions to ask before giving your cat away.

Unfortunately I was in the same position a few years ago. In order to safeguard my cat I asked the person to sign a document saying they would not let the cat outdoors and if for any reason they found they could not keep it, they were to give me first right of refusal before finding another home for it. It will give you a little peace of mind knowing if it doesn't work out the cat won't end up in a shelter.

No, but it's always good to charge a small fee when adopting out a pet, even if it's only ten dollars. It prevents the people who adopt animals to sell for medical research from getting their hands on your fuzzy little friend. These people, as a rule, never pay for animals.

You should charge a nominal fee and at least have the person provide their name, address and phone number, and a character reference whenever a pet is adopted. It helps to discourage people who might be abusive or irresponsible.
