And you should obtain it before paying them. After paying them, many people will tell you to take a hike if you ask them to complete anything that has to do with taxes. Then, you are left to explain to the IRS why you do not have their SSN or TIN.

If you are using a 1099 to report your expenses and thier misc. income, then no, you don't need the I-9. If you issue them a W-2, then yes you will. The 1099 indicates that they did some work for you and you paid them and you either withheld taxes or not. I would check with the IRS to be sure.

Yes. The I-9 form is the form you use to request their SSN or ITIN. You need that number to complete the 1099.
