Can the birth certificate have the fathers last name for the child when the parents aren't married legally.

In the USA there is no law regarding the last name of a child whose parents aren't married.

My brother-in-law had three kids out of wedlock and all three too their mothers' names or the name of the man she married later on.

If the parents are on speaking terms the kid can have the father's name.

There's no law saying the child of MARRIED parents have to take the father's name either!

If the mother's family name risks dying out because there are no sons to continue it, the for heaven's sakes give her birth name to a son!

There are no laws regarding naming a child. It is whatever the two of you agree on. He/She can have the fathers or the mothers last name or you can hyphenate the last names. The fathers name can be on the birth certificate, but it doesn't mean the child has to have the fathers last name.

There isn't any law.

It didn't used to be a problem because most babys were born to married women and men.

My daughter has two kids. The daughter has her mother's last name. And the son has the boyfriends last name. Crazy I think
But, that is how it is now a days.

Pretty much it seems that the mother has the choice of what name is used. If the dad wants his last name for his kid, he probably has to go to court. Sick huh

The child can have whatever last name the parents feel like giving him regardless of being married or not.

Yes - my friend had a baby they weren't married but the child took the father's last name...I have a son me and his father are engaged but no we are not married yet but our son has my last name ....we plan to change my nad our son's last names at the same time.....It can really be either legally it dosen't matter...

Yes as long as the dad is there to sign the birth cert and take responsibility for the child the baby can have his last name. If the dad is not their to sign cert I'm sure than the baby would have to have your name!

You can give your baby any name you want. As far as I know there are no laws stating otherwise. I gave my daughter her father's last name and we are not married.

Theres no law that says you have to be married to have babies.

Accordingly there is no law that states what name the baby should or shouldn't take.

That is solely up to the parents to decide.

You can name him Jason Baby Cupcake if you want to and it's nobody's business but yours and mamas.

Yes, well at least in Canada you can. I gave my son his dad's last name even though we aren't legally married. I think you could probably name the baby "skippity do diddly bop" if you wanted to.
