Is it permissible to rent a café that offers “hubble-bubble pipes” in order to sell food? *Note: hubble-bubble pipes is sheesha, but flavoured*

Question:
There is a cafeteria in one of the casinos. Is it permissible for me to rent it in order to sell food? Please note that the cafeteria only offers tea and hubble-bubble pipes – what is the ruling on that?.

Answer:
Praise be to Allaah.

It seems that it is not permissible for you to rent this place to serve food and drink, because smoking the hubble-bubble pipe is haraam, as it is a waste of money and causes the Muslim to harm himself and others who smell this foul smoke. See question no. 10922[ http://www.islamqa.com/index.php?ln=eng&QR=10922 ] and 7432[ http://www.islamqa.com/index.php?ln=eng&QR=7432 ].

The basic principle is that the Muslim should avoid these places of sin and keep away from them, and he should not offer them any help or serve things that will make people stay there longer such as permissible food and drinks. Renting part of the casino in order to serve food to these sinners goes against the command to the Muslims to change evil wherever he sees it, and it goes against the command to avoid places of evil and sin.

Allaah says (interpretation of the meaning):

“And it has already been revealed to you in the Book (this Qur’aan) that when you hear the Verses of Allaah being denied and mocked at, then sit not with them, until they engage in a talk other than that; (but if you stayed with them) certainly in that case you would be like them”

[al-Nisa’ 4:140]

al-Qurtubi (may Allaah have mercy on him) said:

The words of Allaah, “then sit not with them, until they engage in a talk other than that”, mean: something other than kufr.

“(but if you stayed with them) certainly in that case you would be like them” – this indicates that it is obligatory to avoid sinners if they are openly committing evil, because whoever does not avoid them is effectively approving of their actions.

Tafseer al-Qurtubi, 5/418

Shaykh Ibn Baaz (may Allaah have mercy on him) said:

Denouncing evil in one's heart is obligatory for everyone. This means hating and despising the evil action, and keeping away from those who do it if one is unable to change it with one’s hand (by taking action) or with one's tongue (by speaking out against it).

Al-Darar al-Sunniyyah fi’l-Ajwabah al-Najdiyyah, 16/142

Indeed, the owner should not rent out his stores to those who will use them for sinful purposes.

Shaykh ‘Abd al-‘Azeez Aal al-Shaykh was asked:

My father bequeathed to me one-third of the rent of a building that he owned. This building is rented out to stores, some of which sell cigarettes and hubble-bubble pipes, and there is also a store that sells music tapes. Is this bequest permissible or not? Please note that we do not own anything else. May Allaah reward you with good.

He replied:

What you have to do is to evict these people, because selling cigarettes and hubble-bubbles and music tapes are all things that go against sharee’ah, and it is not permissible for the Muslim to help others in sin and transgression. Allaah will compensate you with something better, in sha Allaah, and you will be able to rent it and earn from it in such a way that will benefit you and benefit the deceased, in sha Allaah.

Note that whoever gives up something for the sake of Allaah, Allaah will compensate him with something better than it, and that provision cannot be acquired by sinful means. Allaah says (interpretation of the meaning):

“And whosoever fears Allaah and keeps his duty to Him, He will make a way for him to get out (from every difficulty).

3. And He will provide him from (sources) he never could imagine. And whosoever puts his trust in Allaah, then He will suffice him. Verily, Allaah will accomplish his purpose. Indeed Allaah has set a measure for all things”

[al-Talaaq 65:2-3]

Yes, shisha (if you mean Mu‘assel) is just tobacco of various flavours and strengths, its no different to smoking a cigarette in terms of what is allowed.

"Truly, what is lawful is evident, and what is unlawful is evident, and in between the two are matters which are doubtful which many people do not know. He who guards against doubtful things keeps his religion and honour blameless, and he who indulges in doubtful things indulges in fact in unlawful things, just as a shepherd who pastures his flock round a preserve will soon pasture them in it. Beware, every king has a preserve, and the things Allah has declared unlawful are His preserves. Beware, in the body there is a flesh; if it is sound, the whole body is sound, and if it is corrupt, the whole body is corrupt, and behold, it is the heart." (Sahih Bukhari and Muslim)

My first question to you is, do you know why Smoking is haram?

First: we All know the dangerous of smoking. It’s a fact that it leads to cancer, liver damage, lung disease, heart disease, brain damage and other diseases.

Allah (The Compassionate) says :-

“…And do not kill yourselves (nor kill one another). Surely, Allâh is Most Merciful to you.” (The Nobel Qur’an, Surah An-Nisâ' 4:29)

And the Prophet Muhammad (peace be upon him) said:-

"… and whoever drinks poison and kills himself with it, he will be carrying his poison in his hand and drinking it in the (Hell) Fire wherein he will abide eternally forever; ..." (Sahih Bukhari)

The Prophet Muhammad (Peace Be upon Him) said:-

“…everything that causes intoxication is forbidden.” (Sahih Muslim)

Insha’Allah this evidence should be enough to refute and claims that Smoking is Halal.

Insha’Allah if you wish, I can send you detailed fatwas on this issue.

the reason i havent added them here is because when i do, most people come up with excuses that they dont follow so and so imam, or my imam says its OK, or my Dad does it, so its OK, etc. so i have provide clear proof fromQuran and Sunnah only. now the question you have to ask is, am i going to reflect on the evidence and commands from Allah, or any you going to be ignorant and keep doing what you are now? remember, ignorance is NOT an excuse on the day of Judgement. Allah (The Most Merciful), just wants best for you, but sometimes this Dunya blinds us:-

"...and it may be that you dislike a thing which is good for you and that you like a thing which is bad for you. Allâh knows but you do not know." (The Nobel Qur’an, Surah Baqarah 2:216)

[for those who say that ther parents "force" them and they want to respect them because Allah says so in the quran. my sincere advice to you is understand the difference between respect and obedience! Yes you must respect your parents, but our loyaltly and obedience is for Allah only! if they force you to do somthing Haram, you have a duty to not do it and try reason with them in the best of Speach. this is some beautiful Advice given to me by Mufti Muhammad Ibn Adam and Allah knows Best]

Ok, so what is shisha? Shisha is tobacco smoked through a water pipe. The flavored tobacco of the shisha has less nicotine, by content, than traditional forms of tobacco, but the high content of glycerin in shisha tobacco is disheartening. “Glycerin could be toxic to the lungs. Long term shisha smoke could cause emphysema, which is a lung condition that is irreversible”. [Kareem Elshatory M.D., http://askdoctor.medislam.org]

Clearly it is Bad for you

The Prophet Muhammad (Peace Be upon Him) said:-

“…everything that causes intoxication is forbidden.” (Sahih Muslim)

Allah (The Compassionate) says :-

Finally, some words from a scholar from Arabia (where shisha is done most frequently):-

The only issue remaining is about Shisha (Water pipe) which is a million times more harmful than cigarettes. And since boys and girls have the habit of smoking Shisha, this doesn’t mean that it is less harmful. 15 years in our countries, the ones who smoked Shisha were seen as low class. Be aware that the 4 million people that die every year, half of them die because of Shisha. Don’t fool your self and say Shisha is less harmful than cigarettes. This isn’t true. The smokers of Shisha are more affected by mouth cancer and lung cancer, so it is not less harmful than cigarettes.

This is scientifically proven: One Shisha is worth 55 cigarettes. And still you say that it isn’t harmful! Moreover, all the scholars say it is haram for a certain reason. The fruity smell contained inside comes from corrupted fruits that turned into alcohol. Then it is one of the big sins in Islam! Imagine a country like Thailand (a country so far from our religion) prohibited the smoking of Shisha. This was the decision from the President. Do you know why?! Because it leads to uncivilized behavior. Do you know why I'm saying these words? Frankly because Shisha became a place for the unemployed, hence they would occupy their time with this. Once a girl said to me, ‘while I was smoking Shisha, I noticed that it smells different. When I asked why, they told me they had put Marijuana in!’ And the girl said I didn’t know that it had marijuana, but since then I had the courage to take drugs!

Shisha (water-pipe smoking) won’t build our nation. People can’t be excited to any development plans, or civilization success with this thing spreading among our youth. The most dangerous thing is that it changes the social face of our life. Ask any wife, her husband spends his time at the café smoking Shisha. Cafes have become trendier, but who are the people who sit on it? What issues do they talk about? And what are they going to do after they smoke it?

This is a huge collapse in our society, an early kill to the minds of boys and girls. Where is the shame of the self? I swear by God, Shisha makes you fail in your life. 15 or 20 years ago, it was impossible that a woman would smoke Shisha; they considered it as an insult. Shisha is haram, it corrupts society, and it kills the minds of our youth. They think they are smoking and killing time, but they don’t know that they are killing themselves and their bodies. At least cigarettes are smoked while working, but Shisha really kills time. I want any woman to ask a man, even if he is a smoker of Shisha, “Do you respect the woman who smokes Shisha?” Just ask and judge for yourself.
