If they are observed under the rules of engagement and within the articles of war & UCMJ presenting any kind of threat to persons or property - they should be immediatly engaged, shot, bombed or taken into custody as a last resort. It's hard to tell who is who in a war zone if they wear the same uniforms and carry the same weapons. Caution must be observed so we don't have a friendly fire situation. History has it's share of stories like the 442nd in Italy especially Sen. Daniel Inouye of Hawaii who earned the MOH. But these days we can segregrate or racially profile people based upon their race as we have many arab americans in our uniforms honorably serving our country.
Difficult question - but are there any Lawyers with the right answer?

US soldiers in marked uniforms can be shot as soldiers but not as spies since they work in the open.
Iranians can who are operating as spies and insurgents can be shot within international law

Yes if the enemy is found in a US uniform they can be shot as spies and probably would

SPIES ARE OPERATIVES IN CIVILIANS CLOTHES NOT FOOT SOLDIERS IN UNIFORM. OBVIOUSLY, IRANIANS RUNNING AROUND FUELING THE SECTARIAN VIOLENCE WITH MONEY AND ARMS HARDLY QUALIFIES THEM AS NONCOMBATANTS. HOPEFULLY WE CAN SHORTLY REFER TO THEM AS "NEUTRALIZED."
