both. You are required by your policy contract to report all accidents to your insurance company even if you are not making a claim against your policy. And if you want the idiot's company to pay for your damages you call them and make a claim.

In any accident, it's important to notify your own insurance carrier; they will, in turn, investigate and inform the "idiot driver's" insurance company. You can't even tell if the other driver's insurance is real, valid, expired or suspended. That's why you should always notify your own company and let them work it out.

Make sure you give the insurance company all of the pertinent detsil (witnesses names if applicable, Police Report number, both driver's id, plate numbers, how the accident happened).

First make sure nobody is hurt,Then call police so that a police report is made and possible citation is issued (hopefully to the other driver) then get all the other drivers info..Insurance co name,his or her name DL number ,and a contact number for the driver. You should then pass the same info about yourself to the other driver. and watch out for someone who says they don't want to involve police or insurance cos and they will pay you cash for repairs because this is most likely BS and yes call your ins agent and let them handle it
