Hi ,

Recently cop gave me fine for not wearing a seat belt. but actually what happened.

i was taking left turn.i was already on the road, that's why even though red arrow is on, i took left turn.
he stopped my car for not giving yield . when stopped my car , i was in tension , i forgot that i shouldn't take out my seat belt.i'm driving since years.this's first time car stopped my car.

when cop was coming towards my car, to take out the purse from the pant i take off my belt .

that's why cop misunderstood me that i didn't wear seat belt. he gave fine .

now i have 3 questions in my mind. i don't know whith whom i have to clear my doubts, that's why i'm writing this to get help.

1. can i attened the court for not pleing guilty.
2. is the cop can see traffic lights cameras for the prrof (i had seat belt on while i was driving).

3. is that violation fine goes to my DRIVING RECORD.

please clear my doubts.

Laws are unique to each town/state, so any answer here is going to be a recommendation based on the location. Here's mine:
1 - You can pay the fine and not go to court, or go to court and try to fight it. You'll probably lose and end up paying the fine anyway. "Innocent until proven guilty" has never been my experience when it comes to traffic court. The judge favors the cops.
2 - They might be able to see the cameras. Sounds like you need a lawyer to subpoena the records. How much will a lawyer cost?
3 - If your ticket is for the seat belt, this probably isn't a moving violation. You're okay. If it is for running a light, etc., it is a moving violation and will go on your record.

I recommend paying the fine and be done with it. It won't affect your insurance because it is not a moving violation. Let out a sigh of relief because it could have been worse.

1) you can take your chance with the judge and tell him your side but if lose then they will add on court costs to the fine, around $30.00 extra.
2) You could ask the chief of police to view the traffic light cam on that day and time if there is one. If the cam caught you in the intersection after the light went red , they WILL issue you another ticket for that too.
3) seat belt tickets are not a moving violation and will not go on your driving record for your insurance to find.

It would really help if you could spell and make complete sentences. Anyway, it is basicilly your word against his. You made the first error by disregarding the traffic law and getting his attention.
1. Yes, you can plead not guilty and provide your explanation/proof.
2. If there was a camera at this intersection than you can request the tape be reviewed for your claim.
3. The points will go on your driving record.

Actually he is doing you a favor. Instead of a moving violation which would add points to your license for running a red light, he gave you the lessor non moving seat belt violation. Pay the fine and be very thankful he did.

ok here you go 1st go to court and explain to the judge,2cnd the cameras may show that you had the belt on but they are not going to rerunn them for the simple charge, and ive had the same thing and it didnt show on my record, i would just send in the payment required and be done with it, because in the long run it will end up costing you more for court cost and everything, and you end up paying the fine any way.....

You should plead not guilty and give your explanation as you gave here (if you can take the time off work).

You can check with your insurance company whether or not this will affect your driving record. I don't think it will.

when it comes to court the police are always right, the judge usually sees to that.
