Generally a small stakes poker game among friends is fine in most states. The problems come when you either invite strangers to the game or charge a rake.

Host a game at home and have a great time....Don't forget the snacks. When we host games, we usually play quarter/dollar limit poker and evey three hands we push out 50 cents of the complete pot into a bucket. This money goes to the next person hosting the game to buy snacks, drinks etc. We don't usually care about reciepts because the snacks are always good and you really don't collect all that much anyway for the bucket.

Generally if the host is not making a profit off the game then it's legal. So if there's no rake then there's no profit, and hence it's legal.

it is prohibited yet while it is barely a delightful interest with human beings you recognize then i don't see any worry, its purely once you have a visitor who isn't your buddy and he loses or purely gets disillusioned for some reason then you definately've a controversy with the police. maximum video games take 10% on their video games so 5% isn't that undesirable for the rake. purely confirm you're raking the pots for the superb volume.
