I bought a Nintendo Wii on ebay from a guy in CA. I used to live in Delaware, but I now live in PA. This guy used Fedex and shipped my item to an old address in DE. The person now living in my old apartment in DE forged my name and now has my Wii. The reason he shipped this to my old apartment is because Fedex does not ship to P.O Boxes...which I did not know. What gets me, is the fact that this guy took it upon himself without notifying me and shipped it to another address I did not specify. He shipped it almost 650 miles away from where I live! The address in DE was on my ebay due to the fact of a recent move, ALTHOUGH, I specifically put another address down which is shown on both the Ebay and Paypal receipt. BOTH Ebay and Paypal, will do nothing for me, I put in a claim and I waited, because I have a full time job with 50+ hours weekly I can not check all the time, so they decided to deny my claim on a week I did not check. I have all documents and info on the seller.

Since the resolution center is nothing but a gimic with Ebay and Paypal and there is no security in the trading process. I cant believe it, I even called them numerous time asking how the process was going. Then when I stopped and figured I'd wait it out, they just decline me in a second. What good is the whole Ebay Process if you cant be comfortable in knowing that your money is safe? We are talking some 500 dollars here! What can I do to sue this person all the way in California? What steps should I take? If anyone can help me or know someone who can send me an email if you would like. It will be placed in my profile. Thanks!

The Fedex signature was "direct signature" meaning all the deliverer has to do is get a signature from the person at the location. The person at my old apartments signed my name. But he could've signed anybodies name! It doesn't matter to Fedex. Its like if a package comes to the house for my mother...I'll sign for it...but its hers. They only want a signature from the location.

I've read through the ebay policies just now, I see nothing about keeping your address up to date. In reality it shows where I want it on the receipt. Thats where it should have been sent, but he sent it somewhere else.

You can only sue the person in DE that forged your signature. You have to call the District Attorney's office in the location that the crime took place.

I had trouble with eBay before and your right the complaint department is full of crap. You can sue the people that forged you name. You should call the courts in that area and find out what to do. Forging someones name is a crime. If your old address was on you profile then it is not the sellers fault. You should definitely call the state it was mailed to and see if their is anything that can be done to get the game system back or the money from the people that signed for the package. Sorry what happened to you. Ebay is really not a good place to shop, I found out the hard way too.

First, it's not the guy in California's issue. He mailed the package. Fedex should have some insurance on the package. I would file a claim there first. Then, if you used Pay pal, hopefully you used your credit card. Contact the credit card company and file a dispute with them stating non-receipt of goods. The one you want to focus on is Fedex since they handed over your goods. Now, exactly how do you know they delivered a Wii to Delaware and not some box full of nothing?

FedEx delivers to addresses. Anyone who accepts the package only needs to sign their names, not the "addressee's". The person receiving the package would not have known who it was addressed to in most cases.

It seems to me that you just didn't receive the item purchased. Period. Who cares that it went 650 or 6,500 miles away.

Replace your claim. It's the fact that no deal was made, you did not receive it. Period. Pretty messy.

Call the Prosecuting Attorney's office in the seller's capitol city. Ask them.

nicely I stay in the two!!! I unquestionably have lived in CA seeing that 1969, and we've at the instant bought a place in my place of birth (see my nick), so we've a foot in the two. We ignored the 4 seasons, the rustic existence (we bought out of city), the softer panorama, much less site visitors, and the decrease cost of residing in PA. And oh specific, family contributors. on the comparable time, we like the multiculturalism, the open and innovative attitudes, the magnificent delicacies, the panorama continuously in bloom, and of direction the widely sturdy climate in California. How's THAT for being indecisive? :)

I believe there is information on ebay that will help you they also get involved and can kick that person off ebay. look into the ebay first and call if they have a number

I am inclined to agree with Answerer 1. You will have to take action against the person who forged your name and signed for your parcel.

Unfortunately there is nothing you can do against the person who sent you the Wii. You should have made certain that the address he was to send it to was correct in your EBay details.

EBay states in it's policy that the good are to be sent to the address on file, NOT the address that you email the seller to send to.

EBay and Paypal will do nothing, because the item was sent, with signature required at the other end.
