I have a question on the Mississippi state gun laws. My daughter was caught concealing alcohol in the Liquor and Wine store in Biloxi. Realizing the consequences, she was putting the liquor as the store clerk said "I know what you're doing! You're stealing from me." She opened her jacket to show she had put it back and that she meant no harm. She then tried to leave, not realizing that since she didn't "steal" it, that she did something illegal. She then tried to leave the store and kicked the door to try to leave. The store worker then pulled a gun on her and ****** it back ready to shoot. My daughter is sixteen years old and the tape shows she did nothing but kick the door to cause this man to pull a gun. Is it legal in the state of Mississippi to pull a gun and cock it back, ready to shoot, if they do nothing to provoke it?????? Thank you.

Shoplifting in Mississippi only requires that the object be concealed,not needed to take it out...concealing shows the intent and that is what the law requires......anybody can pull and cock a gun if they feel threatened....kicking a door can possibly show or indicate aggression and anger...if he can make a case he was afraid,no matter what the tape shows,hes good......does the tape say what your daughter said to him while she was trying to steal?...did she curse him or yell at him whaile she was commiting a crime?...this "poor little innocent child" routine gets tiresome....she is 16,stealing iilegal booze...shes no wallflower....and where were you while your daughter was out stealing booze on the streets?...did you know where she was?...who she was with?....did you know she is an alcohol user?......... you need to quit worrying about a lawsuit against that store and worry about what your daughter is up to every day......shes lucky all she got was pointed at...you could very easily have lost ehr and then what?.....the clerks fault I guess huh?

The stoorkeeper over reacted. Since your daughter showed no agressive or deadly force behavior towards him, he was wrong to pull a gun.

You can shoot anybody at anytime in red states.
