He is no longer a Muslim, angers Allah and only Allah is suitable to judge or punish him.
They cannot remain a Muslim, because the first rule is to believe that the is only one God. Atheist have no such belief.

Simply put, Islam orders us apostates to be killed:
Death for apostasy:
The Quran
Sura 4:89 They long that ye should disbelieve even as they disbelieve, that ye may be upon a level (with them). So choose not friends from them till they forsake their homes in the way of Allah; if they turn back (to enmity) then take them and kill them wherever ye find them, and choose no friend nor helper from among them,”
The Hadith
Sahih Bukari Volume 9, Book 83, Number 17:
Narrated 'Abdullah:
Allah's Apostle said, "The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims."

They can be so. If we talk about silly societies.. then nothing good there, no matter they muslims, christans or jews or whatever.
But they will remain Muslims unless they convert to any of the Divine religion. Otherwise if they want to be an atheist.. officially they will be called Muslims.

It clearly states in Quran that religion is not to be forced and as we can see from the following verses that apostasy is not to be condemned by death. It does not say that anywhere in Quran. Some Muslims believe they should be but i think they are wrong.
2:256 "Let there be no compulsion in religion...".
10.99: "If it had been the will of your Lord that all the people of the world should be believers, all the people of the earth would have believed! Would you then compel mankind against their will to believe?"
42.48: "If they turn away from thee (O Muhammad) they should know that We have not sent you to be their keeper. Your only duty is to convey My message."
18:29: "(O Prophet) proclaim: 'This is the Truth from your Lord. Now let him who will, believe in it, and him who will, deny it."

Apostasy is punishable by death.
Mohammed said, "Whoever changes his Islamic religion, kill him." Vol. 9:57

He could be killed / she probably would be killed. Islam is a barbaric, violent religion hiding behind the lie that it is peaceful. Muslims say that Allah is kind and loving but that is not true of Allah's followers.

here in egypt either the gov't with imprison you or your family will kill you. Happens all the time here.
