You said, "were separeted I only made $ 8000". Did you mean, "We are separated, and I only made $8000", or "Separately, I only made $8000"? You also said, "he didnt work a month or two". Do you mean he worked 10 to 11 months? If so, he probably brought in some good money.

There are advantages to filing separately, but unless you are using a long form (a.k.a. Schedule A), you won't see the advantage. Just file Jointly and save the time/effort/cost of filing two tax returns. If you are separated and not talking, you may be forced to file "Married filing Separately"...but I'd avoid it at all costs. This is especially true if you are claiming any children at all.

Do you have any children? If so, you might want to see if he will file jointly so that you can get EIC. If you have no children you may as well file separately this year as it will make no difference to your tax bill.
