My friend was pulled over in texas, but there were no drugs in his vehicle, but his friend had a vehicle on?

a tow truck with dope in it, they pulled over my friend for not signaling and he gave consent and they found nothing, but they did in the car on the tow truck which was in the other guys name. But they still took my friends car and he still has not been able to get it back even though there was nothing in it. What should he do?

As he is the driver, he is responsible for his vehicle and whatever he is towing. He gave permission and that is enough. If he can prove the car is his friend's and in his friend's name he might be able to make a deal with the attorney, but his car was seized because it was all part of the same "vehicle".

I believe the police have 30days after seizure to determine if they will proceed with (STATE) Forfeiture of the vehicle. Because he was using his vehicle to facilitate drug trafficking the police have a right to seize it. The next step is if they will take it federally or state. If they take the forfeiture federally then this is what happens: the owner of the vehicle will be notified by registered mail (most likely within 60 days of seizure) and he can submit a claim and/or petition on the vehicle to have it returned. He will be notified where to send this notarized paperwork. He needs to be vigilant calling whoever took the vehicle and possibly going by their office. If it is registered in his name then they must let him know the status. This all also depends on the value of the car. If its a low value car (less than 5K) they won't bother most likely.

offences, this is a crock of, you knew about the s---t,
plead it out through an attorney and take what you can
