can anyone tell me how my boyfriend would be able to claim my son since I didn't work at all and he was the one who supported him he is not his real father.But the tax places keep saying that he can not claim him like he claims or son but how do all these people claim other peoples kids and they don't live with them or support them I think that is messed up.

he can claim him as his foster child. just put down "foster child" and as long as no one else claims him, it will be alright.

He would be able to claim your son, but only if your son lived with him for the entire year (January 1 through December 31) AND he provided at least 50% of your son's support for the year.

If a child lives with a parent and a non-related person, the rules for dependency make it impossible for the non-related person to claim the child, regardless of the support provided by the non-related person, or the amount of time the non-related person lived with the child.

These rules went into effect in 2005 and many people do not understand them, or remember rules from previous years that were different.

As you state from your question, there is a lot of tax fraud going on involving dependent children.

"ninasgramma" is correct.

As long as your son is your "Qualifying Dependent", your boyfriend can not claim him, even if you do not file.

These rules changed for the 2005 tax year and are still in effect.
