my friend(the one who got his Ipod taken) always left it just laying around like out in public and at school and everything and we always said that he would eventually get it stolen one day so he did this to teach him to not leaving it lay around everywhere.

Yes, it is stealing whether he returns it or not. Depending on his age and the value of the iPod and any prior arrests and/or convictions it does not seem likely that he would go to jail for it. At most, he might serve 2 or 3 days in the county lock-up if it is his first conviction.

Stealing is a bad plan, and I'm not sure what kind of lesson he is trying to teach. A million $$ would feel good in my pocket too, but I'm not going to steal it.

Taking something that is not yours is STEALING no matter what the situation was. If the person who took the IPod gets caught, he will pay the consequences for his actions no matter what his motivations in the beginning was.

It is stealing, even if your friend was careless with the Ipod. If it doesn't belong to you and you know the owner, you have an obligation to return it.

Behavior you have described is not friendship.
