I am an unmarried man with no children. Every year, I have filed as head of my single person household. This year the rules seem different. Has there been a change in the law?

you must live with a related dependent for at least 6 months and support 1/2 the costs of the home you both live in. the only exception is if you pay for over 1/2 the costs of a home that your parent lives in for the entire year AND you claim them as your dependent.

if you live alone (or with a unrelated person) and you don't pay for 1/2 of the costs of your parent whom you claim as your dependent, then you can not file as Head of Household.

If you say that you filed as Head of Household for the last so many years, I'm a bit surprised the IRS hasn't caught up with you. That is one that they are right on top of. Selecting the Head of Household with no dependents is the reddest of red flags.

You should claim yourself as Single. If you want to head off a large tax bill in the near future when the IRS does eventually catch up with you, you may want to amend any returns you filed since 2003.

Very sorry for the bad news. The laws about needing a dependent for HoH haven't changed in a long time.

As long as you have no dependents then you are single, until you are a man raising children alone, even then you will need to file a form from your wife declaring that you can file the children. So the only way you would be head of household is if you were the sole provider to your children and you were unmarried.

You can't file as head of household unless you have a dependent. If the IRS hasn't audited you for this yet, they will.
