I am going to file my taxes in the next few days. However, I will be helping my ex with his taxes in the next couple of months. He had a hard year in 2006, and I have considered allowing him to claim one of our daugher's if he has a large tax liability. If I go ahead and put her on my return, am I able to amend my return and take her off so that he can claim her in the future? He can't do his taxes for awhile, and I prefer not waiting that long if possible. Please advise!

BEWARE you could flag your return for an audit. As a general rule, whoever the child is living with should report them as the dependent. Swaping them back and forth is not a good idea unless custody issues are changing, as well.

You could do that, but you'd probably end up causing both of you a lot of trouble. If you file with all the kids, then he comes in and files with one of them, your amendment taking that one off probably would not have caught up yet, so it would look like you both claimed the same kid and you'd both be explaining for awhile.

A better way might be to file your return now leaving one of your daughters off of yours, then if you end up not having him claim that daughter, amend your return to add her to yours. That way nobody gets involved explaining to the IRS and defending your claims.

NO!!! You must make a decision to claim your daughter or let your ex claim her. It would only cause problems in the future and a better chance of being audited. Good Luck!!!

With all due respect. If you take care of your children over 50% of the time, you claim them. Period. Rasing kids is not easy and will all have it hard sometimes. Tell him to man up.
