Is it legal to claim my boyfriend who did not work during 2006?

You have to meet 4 tests:

1. He must have lived with you for the entire year. If he move in on Jan 2nd or out on Dec 30th, you can't.

2. Your relationship cannot violate local laws. If there is a local law against co-habitation you cannot claim him as a dependent.

3. You must have provided more than 50% of his support and be able to prove it.

4. He cannot have had more than $3,300 in income for the entire year.

If you meet ALL of those requirements you may claim him as a dependent.

You may NOT claim the EITC, however, as he is not a qualifying dependent for the EITC.

Only if he lived with you for the full year AND you provided at least 50% of his support.

jseah114 and bostonian are correct, if the tests are met, then you can.

But you can't file as head of household based on having him as a dependent.

Absolutely NOT!
You can not claim an adult as a dependant unless it is your child in college, or if the adult is impaired in some way.
