If you hubby is the higher ranking soldier, he'll get the charge of frat; the lower ranking soldier usually doesn't get that charge.

I am retired military. There are three charges involved here. Adultry is against the UCMJ as is fraternization if one of them is an officer. Also conduct unbecoming and they will surely lie about it which will lead to a false official statement charge. If you have some type of proof take it to the base legal office (not his command) they will institute an investigation. If he is found guilty that is some strong stuff in a divorce case.
Small word of advice make sure this is what you want there is no turning back.

you can talk to the commander, the MPs, JAG, CID, or family support agencies. I would go the CID route just to be annonymous, but the thing you need to remember is that adultery in the army is very hard to convince and prove. You basically need video evidence or a taped confession from both involved. I got the taped confessions in my case but since the guy didnt know he was being taped, it was thrown out and inadmissable. So just letting you know, Good luck.

Two choices.
Go to the MPs once you know they are together, so you can have proof. His Command will try to help out your husband so you will need prove. With this option you have no turning back, specially if he goes to jail, think about the alimony.
2. Go straight to his commanding officer, they will try to kep it under the table but they will try to make it stop. So its your choice.

Just divorce him. Why do you want to destroy him. Think of all the benefits you will and ill will you will create that can never be undone. This is problem is between you and your husband. Handle it without being hateful and vindictive. It will come back to bite you when you least expect it.

If you have proof, sue for divorce, citing the adultery. Trying to tell the military is just a loser for you. The only thing that means anything in the military is if they are caught or one or the other brings charges for harassment.
