A ticket for parking on the sidewalk! I parked in front of the large garage doors and went inside to open the doors to park inside. when i came out 2 New York police officers were writing me a summons for parking on the sidewalk. I tries to explain and they just told me to have a seat in the van anf gave me a ticket. Were they wrong in doing this? Can I fight it in court?

Usually the cost of a parking ticket is not worth the time and aggravation it takes to fight it (and I have heard that in New York it is really a pain). However, if I were the judge, and the police officers testimony matched yours (e.g., they did not see the van parked for a long period of time before writing the ticket, there were garage doors), I think I would rule that you were not "parked" in violation of the law.

It sounds like the officers had little discretion in their involvement. Had I been the officer, I would have let it "slide" however, you WERE parked on the sidewalk therefore the offense DID occur.

Yet, I can't help but think you've nothing to lose and everything to gain if you talk to the judge on your court date.

Best wishes!

Well. You were parked on the sidewalk. You say so yourself.

Where are pedestrians supposed to walk to get around you? The road?
