The Weapon belongs to the owner of the house that was arrested and you were there so now your guilty of the weapon?

this is a question for a lawyer not yahoo answers.

if you can make a sweet enough plea bargain, then it almost always makes more sense than going to court where you can never predict the outcome. this is especially true if you have any kind of prior criminal record.

if you can plea something down to the point where the d.a. and judge are willing to give you a 'continued without a finding' verdict, then that is something you should seriously consider.

if you can have your case continued without a finding, then you will go on probation for a time, but after that, your life is your own and you will have no criminal record. this kind of continuance will appear as a dismissed case on your record and you will be able to truthfully state that you have never been convicted of anything.

just make sure you don't screw up your probation...

What, specifically, is the charge? Generally, I would say no, don't plead guilty of anything if you are not guilty. However, say you are a convicted felon and the person has a gun in plain sight, you should know that you and the gun can not both be there at the same time, regardless of who the actually owner is.

I would not plead guilty to anything I didn't do. The consequences will follow you for life. If 10 years from now you are again accused of something you didn't do, you will have a harder time proving your innocence if you have a record. Fight to clear your name.

NO........when you are at someone's house the owner is responsible for you it is not the other way around unless it was drugs and you spent alot of time there then you will be charged. They are trying to play you, get anothet lawyer.

Was the weapon in your possession at the time they found you? Might need to check with your lawyer to see what your options are.
