ok its my son, some one is claiming him and we have not givin any one the right to claim him, ive called the irs with no help.

The IRS isn't going to tell you WHO is claiming him, but if you do and someone else does also, they'll contact both of you to prove that you have the right to claim him.

1. How old are you? If its your parents or guardians, they most likely have the right too.
2. Are you married. If you make no income your wife can still claim you even if you object.
3. If none of the above apply contact the IRS. They should be able to inform you of who is claiming you.

Pick up the phone and dial your parents number. Ask "Hello, are you claiming me on your taxes?"
Someone can only legally claim you if you are their dependent. If your parent is not claiming you as a dependent, then you need to claim yourself.
