My friend was arrested last year in the UK for drink driving. He was over the limit so was taken to the police station where he was again breathalysed but was under the limit so was de-arrested and free to go. Should he declare this to the US embassy? Would this show up on the NPC? Is the US embassy able to check for arrests themselves?

I used to be a copper in the UK before moving to the States so I can answer this some authority. Yourr "friend" wasn't charged merely arrested therefore he wasn't prosecuted which means that the offence hasn't been proven in a court of law. However, because he was arrested he will be added to the Police National Computer as a "nominal". When I applied to the Embassy I can't remember if they asked for convicted offences or arrests. Check your paper to be specific. If they ask for arrests then declare it. Its better to be honest otherwise they'll wonder what else you are hiding. The US Embassy do not have access to PNC, they have an arrangement with the Home Office whereby background checks for Visa applicants are conducted by New Scotland Yard. Hope this helps.

If the application asks for arrests he should declare it and report the outcome. It is not going to affect anything but if they do check and it shows they will wonder what else he didn't put on the form.

No there is no need to declare ....the check done at the road side is only an " indication " of driving over the limit ...the test done at the police station gives an exact reading ...therefore if he was found to be under the legal limit - he hasnt committed any offence
